General Terms and Conditions
1. Requirements and Duration
- Driver's License: The customer must hold a valid driver's license issued at least 3 years ago.
- Minimum Rental: The minimum rental duration is 1 day.
- 24-Hour Rule: The rental day starts at 09:00 AM and ends at 09:00 AM on the following day. Rentals starting at intermediate times will still terminate at 09:00 AM on the following morning.
2. Restrictions and Fuel
- Exclusive Use: The vehicle must be used strictly and exclusively on Ischia Island.
- Mainland Ban: It is strictly forbidden to transfer or board the vehicle onto the mainland.
- Terms: The rental is intended as self-drive (without chauffeur), fuel excluded, and includes unlimited mileage.
3. Vehicle Condition and Return
- Initial Inspection: Any pre-existing damage or anomaly must be reported before departure; otherwise, the vehicle is deemed to be received in perfect order and condition.
- Return: The customer agrees to return the vehicle in the same condition (except for normal wear and tear) to the Dealer's offices exclusively during official opening hours.
4. Liability, Damages and Theft
- Duty of Care: The customer must drive and maintain the vehicle with the utmost diligence and care.
- Damages & Theft: Full liability applies for damages caused by misuse or disproportionate wear. In the event of vehicle theft, the customer is liable for its full value.
- Mechanical Breakdown: In case of breakdowns during the rental period, the Dealer is not liable for contractual or extra-contractual damages suffered directly or indirectly by the customer.
- Lost Property: The Dealer declines all liability for objects left, lost, or forgotten inside the vehicle, both during and after the rental.
5. Fines, Penalties and Impoundment
- Direct Liability: The customer is solely and directly liable to the Authorities for any traffic violations committed during the rental period.
- Administrative Fee: A fixed administrative fee of € 25.83 will be charged by the Dealer for processing each traffic fine.
- Notice of Violations: The customer must forward any fine or notice received to the Dealer within 2 days of receipt, failing which they will be held exclusively liable for any financial damages suffered by the Dealer.
- Vehicle Impoundment: In the event of seizure or administrative impoundment attributable to the customer, they shall pay the Dealer an amount equal to the daily rental rate for each day of vehicle downtime.
6. Insurance and Accidents (Claims)
The vehicle is covered by a third-party liability insurance policy (R.C.A.) in compliance with applicable laws. Pursuant to Art. 1913 of the Italian Civil Code, the customer is legally obliged to report any accident to the Dealer by signing the appropriate claim form.
Mandatory procedure in the event of an accident:
Provide the names of all parties involved, their respective insurance companies, and any witnesses.
Do not admit liability or fault unless absolutely certain of the dynamics.
Do not leave the vehicle unattended or without adequate safeguarding.
Notify the Dealer immediately after the incident.
